By accessing or using Chargestack's charging station management platform and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Chargestack provides a cloud-based platform for managing electric vehicle charging infrastructure, including:

• OCPP 1.6 and 2.0.1 protocol support for charging station communication
• Multi-tenant charging station management
• Usage-based billing and payment processing
• Real-time monitoring and analytics
• RESTful API access for integration

3. User Accounts

3.1 Account Creation

You must create an account to use our Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use

You agree not to use the Service to:

• Infringe upon the rights of others
• Transmit malicious code, viruses, or harmful software

5. Billing and Payment

5.1 Subscription Fees

Our Service operates on a usage-based billing model. You agree to pay all fees associated with your use of the Service according to the pricing in effect at the time the charges were incurred.

5.2 Payment Processing

Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for all fees incurred.

5.3 Refunds

Fees are non-refundable except as required by law or as explicitly stated in our refund policy.

5.4 Subscription Cancellation

You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Chargestack and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Data

You retain all rights to the data you submit to the Service. By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of providing the Service.

7. Data Privacy and Security

IN NO EVENT SHALL CHARGESTACK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

You agree to indemnify, defend, and hold harmless Chargestack and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

11. API Usage

If you use our API, you agree to:

• Comply with rate limits and usage restrictions
• Use API keys securely and not share them
• Monitor your API usage and costs
